Jim: Won a TRO in Fed Court; Now Need Help w/ Security Bond
To Jim and any other lawyer on the site: So, I won a motion for a Temporary Restraining Order in Federal Court (Southern District of New York) today for a rather rather rather large client that you've all heard of. Cool. But now, I have to post a "security bond" in the amount of $2,000. Never had to do that before. Does anyone have any recommendations re: sources for civil bonds in TRO context?

Dumb non-lawyer question: if you Won a GDP against someone else, why does Your client have to post a bond?

Injunctive relief is not an adjudication on the merits, so it is possible that the defendant, having been temporarily enjoined at the case's inception, will ultimately win on the merits. If that happens, the defendant would have been prejudiced by having been enjoined, and the bond is intended to cover (at least in substantial part) his losses.

hm$: that's exactly what we're doing today. (I had to prepare an order, however, per the orders and judgments clerk and submit that to the judge for approval of the payment directly in to the Court's Registry; without the Judge's order permitting payment in this manner, we'd have to post a bond.

Unfortunately, my latest client (attempted murder) is required to post a higher bond....

Unfortunately he is going to have to find $100K, Stefan. We had a horrific homicide up here yesterday, estranged husband kills his wife, two kids, and himself.

I'm a big fan of Canada, I think that country has its act together for the most part.
But that Canucks ice hockey team was obnoxious. Some of those riot images were pretty wild.
I don't usually grow my hair this long but with my music CD and legal thriller novel coming out this year, I figured I would go with the William Kunstler radical-criminal-defense-attorney look. I think it's time for a haircut though.
